The short answer
Usually, yes. A side-return fills the side alley along the boundary, so it almost always runs new foundations right next to — or on — the boundary and the neighbour’s wall. That typically engages section 6 (excavation near their foundations), section 1 (building a new wall up to or astride the boundary), and often section 2 where you tie into or cut into the existing party wall. Expect to serve notices before starting.
Why it matters
Side-returns are particularly party-wall-heavy because everything happens at the boundary. The new wall is usually built on or right up to the line of junction (section 1, one month). The foundations sit alongside the neighbour’s wall (section 6, one month). Tying the new roof and wall into the existing party wall, and cutting in flashings, brings in section 2 works, with a party structure notice under section 3 (two months). Because the work is so close to the neighbour, access and protection (section 8) and a thorough schedule of condition matter a great deal. Side-returns are common in Victorian terraces, so there is usually a party wall on that side and sometimes a wall to a rear neighbour too.
What to do now
- If a surveyor is needed, use one. Both owners can appoint a single impartial ‘agreed surveyor’ rather than one each — quicker, cheaper and less adversarial. Coburns recommends a single agreed surveyor wherever possible.
- Check whether the new wall is on, or up to, the boundary.
- Get foundation depths and apply the section 6 tests.
- Identify any party wall ties or cuts.
- Serve the right combination of notices, and plan access and protection.
Common mistakes
- Assuming a “small infill” is not notifiable.
- Building on the boundary without a line of junction notice.
- Missing the party structure works.
- Skimping on the schedule of condition when working this close to the neighbour.
